Sealed bids will be received by the Fort Sill Apache/Chiricahua Warm Springs Apache Tribe at 43187 US Highway 281, Apache, Oklahoma 73006, until 2:00 p.m. on Thursday, the 5th day of November, 2020, at which time they will be opened and read aloud for the Grading, Drainage, and Surfacing of South Oak Street project. The bid opening will be held in the conference room of the Tribal Complex and face coverings shall be required. Project Description 1. The project is located in Apache, OK and consist of extending South Oak Street approximately 0.5 miles from Julia Mahseet Rd. to Rex Ave. 2. The Tract is currently developed with residential housing along the west side of the proposed road alignment and a field with vegetative grasses to the east. 3. The 28-foot wide road (face of curb to face of curb) will extend from Julia Mahseet Road at Station 1+11 to Station 23+64 connecting to Rex Ave. A five-foot sidewalk will begin at Station 7+00 and extend the entire length of the road alignment, transitioning from the west side of the road to the east side; respectively, at approximate Station 15+00. 4. Clearing and grubbing of the site, along with demolition of approximately 1474 SY of existing asphalt pavement will be required. The construction of a Detention Pond and associated Storm Sewer structures is also a part of the Drainage improvements. Pre-Bid Conference A Pre-Bid Conference will be held at 10:00am on October 21, 2020 at the site, next to the Comanche Nation Community Center located approximately 0.15 miles east of the intersection of Hwy 62 (Coblake St.) and Julia Mahseet Rd. in Apache, OK. The Pre-Bid Conference is not mandatory; however, bidders are encouraged to attend. Bidders are welcome to visit the site during normal business hours. The bidders shall be respectful of the current homeowners. Submission of Bids All Bids must be made on the "Bid Form" included as part of these documents. The sealed envelope containing the Bid shall have the following information disclosed on the outside of the envelope: 1. Write the words "Sealed Bid Enclosed" and below it, write the name of the project 2. Name of person, firm or corporation submitting the Bid, and the address of the bidder placed in the top left corner of the envelope. B. The sealed envelope containing the Bid shall have the following documents inside the envelope containing the Bid: 1. Bid Security: The Fort Sill Apache - Chiricahua Warm Springs Apache Tribe requires the following three bonds if the scope of work exceeds the costs of $150,000: Bid, Performance and Payment. The bonds shall be in an amount equal to ten percent (10%) of the Bid with a notarized Power of Attorney, Acknowledgement of Surety, and Acknowledgement of Principals. Signatures of all parties must be notarized. 2. OK Contractor Registration: A copy of Bidder's current and valid Oklahoma Contractor's Registration at the time of Bidding or Certificate of Renewal thereof issued. 3. Debarment Certification Form: Debarment Certification as included in the Bid Documents, completed and signed by the Contractor. 4. Non-collusion Affidavit: Non-collusion Affidavit as included in the Bid Documents, completed and signed by the Contractor. 5. Certification of Non-Segregated Facilities: Certification of Non-Segregated Facilities as included in the Bid Documents, completed and signed by the Contractor. Bidding Documents Bids will be received for a single prime Contract. Bids shall be lump sum and unit price basis, with additive / deduct alternate bid items as indicated in the Bid Form. Digital copies of the Plans and Specifications (Contract Documents) are available upon request. Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above on or after October 14, 2020, upon payment of a deposit of $100.00 for each set, which is nonrefundable. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner or Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from other sources other than the Issuing Office. Important Notes on Project -- The Bidder is advised that the Owner is a federally recognized Indian Tribe constructing the Project under a Contract with a Federal Funding Agency, as set forth more fully in the Bid Form. Award of the project will be contingent upon the Owner receiving funding from the Federal Funding Agency. The Project shall be conducted in accordance with all applicable Tribal, Federal, State and local Laws and Regulations and terms of the Owner's agreement with the Federal Funding Agency. -- Both Indian-owned and non-Indian owned firms will be considered with Indian Preference of one percent (1.0%) to Indian-owned firms. -- Owner may give preference to responsible certified Indian Organizations or Indian-Owned Economic Enterprises; provided that the Owner finds that the certified Indian Organization or Indian Owned Economic Enterprise's bid is otherwise responsive and that the Bid meets any other requirements imposed by these instructions to Bidders (or by any other Contract Documents). -- Certification as an Indian Organization or Indian-Owned Economic Enterprise shall be indicated on the Bid Form, and the said verification shall be included with the Bid Form. -- Contractors that have recently performed similar roadway and/or infrastructure improvements for the Ft. Sill Apache Tribe, should include in their bid packet, a "Satisfactory Reference Letter" from the Ft. Sill Apache Chairperson. -- The selected Contractor shall, in all solicitation or advertisements for employees placed by or on the behalf of the Contractor, state that all applicants will receive consideration for employment without regard to sex, race creed, color or national origin, and that preference shall be applied for qualified Indian applicants. -- All labor and mechanics employed by selected Contractor or subcontractors in performance of the construction work shall be paid wages at rates as may be required by: (a) the laws of the United States in accordance with the schedule of Davis-Bacon prevailing wage rates established by the United States Department of Labor and included in the Project Manual; and (b) Tribal prevailing wage rates, if any, as published by the Tribal Employment Rights Office. -- Contractor(s) and any of the Contractor's subcontractors bidding on this project must be registered in good standing with the State of Oklahoma and have a current Contractor registration at the time of bidding and required to provide proof thereto. Bonding Each bid or Proposal must be accompanied by a Certified Check, Cashier's Check or Bid Bond payable to Fort Sill Apache - Chiricahua Warm Springs Apache Tribe, in an amount not less than ten percent (10%) of the total amount of the bid. Successful Bidder(s) shall also furnish an approved Construction Performance Bond and a Construction (Labor and Materials) Payment Bond, each in the amount of one hundred percent (100%) of the contract amount. Withdrawing Bids No Bid may be withdrawn after the scheduled time for the Bid Opening Specified above. Owner's Reservation of Rights The Owner reserves the right to reject any or all Proposals received, to waive informalities, to postpone the award of the contract for a period of not to exceed sixty (60) days, and to accept the selected best interest of the Tribes responsive and responsible Bid. All Bids will be made on the basis, of cash payment of such Work. The Owner reserves the right to select bids other than the apparent low bid and that the consideration, but not limited to, of bidder's qualifications and experience will be used in selecting the awarded bid. The Owner also reserves the right to reject any and, all Bids, to consider other factors in selecting the Bid which is in the best interest of the Owner, and to waive any, and all irregularities in any Bid. The Owner reserves the right to hold all Bids for a period of sixty (60) calendar days after the date of the Bid Opening to complete financial arrangements.
