Duncan man, 22, charged with rape
A 22-year-old Duncan man arrested Monday and accused of raping his sister's friend before she fought her way free is free on $150,000 bail.
Brice Heath Shephard made his initial appearance Thursday in Stephens County District Court, where he was charged with a felony count of first-degree rape (by force or fear), court records indicate. Shephard was arrested Wednesday after requesting an attorney during an interview with Duncan police.
The investigation began on May 17 after the victim contacted the police, according to a probable cause affidavit filed in court. Duncan Police Detective James J. Egger said the woman said contact with Shephard began when they messaged via Facebook regarding problems he'd been having with his sister her friend. She said she knew the two for about 10 years. She agreed to go to his house to talk further, where the alleged rape occurred.
The woman told a friend of the incident and the friend advised her to send a message to Shephard to get evidence. The affidavit contains the messages:
Victim "Why did u do that even though I was telling you no"
Shephard "I just want to do it."
Victim "Yeah but I didn't."
