Criminal charges filed against Anadarko pastor accused of lewd acts
An 82-year-old Anadarko pastor is in jail in lieu of $300,000 bond after he was charged with 10 counts of lewd acts with a child allegedly committed every Sunday for two years in the church study.
Marion Milton-Otis Toehay Sr., of Carnegie, made his initial appearance Tuesday in Caddo County District Court where he was charged with the 10 felony counts, court records indicate. If convicted, he faces up to 20 years in prison for each count.
Caddo County Deputy Lynwood Smith Jr. stated in the arrest affidavit that he was called to the Anadarko hospital Sunday afternoon on the report of a possible child molestation investigation. He met with the 7-year-old girl and her grandmother. The elder woman said they'd been to church at Washita Full Grace Church that morning, along with her other two grandchildren. She said Toehay is a close family friend she's known her whole life and he served as pastor at the church.
Court papers cite accusations
Following the morning service, the grandmother said Toehay had asked if the children could help clean his offices. According to the affidavit, when she went to check on the kids, the 7-year-old girl and Toehay weren't around. Her grandchildren said they were in Toehay's office and when she went in the room, she said he was in his chair and the girl was between him and his desk. She said she heard Toehay tell the girl to "hurry up, hurry," Smith stated and when she approached, he began apologizing. The grandmother said she then discovered her granddaughter's shorts and underwear were pulled to her thigh. She took the girl from the church to the hospital and reported the incident. The girl was taken to OU Children's Hospital for a forensic interview.
Smith stated he observed the interview. The girl said that "Brother Milton" had placed his hand on her where she was uncovered and rubbed her, the affidavit states. She said he'd been doing this "every Sunday since she was 5 years old," Smith stated.
